Terms of Service

These Terms of Service ("Terms") govern your access to and use of TheOddsAPI ("Service," "we," "us," or "our"), operated by TheOddsAPI. By accessing the Service, creating an account, or using an API key, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

TheOddsAPI is a developer API that returns sports betting odds data, derived analytical signals (fair odds, edge detection, arbitrage, consensus, market analysis), and historical odds snapshots from public sportsbooks. The Service is a data product. We do not facilitate, place, accept, or process any wagers. We are not a sportsbook, broker, or gambling operator.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use the Service. By using the Service, you represent that you meet this requirement and that your use complies with all laws and regulations applicable in your jurisdiction, including those governing sports betting data, gambling, and information services.

The Service is intended for developers and businesses building software that consumes odds data. You are solely responsible for ensuring your use of the Service is lawful where you operate.

3. Accounts and API Keys

Access to the Service requires an API key issued by us. You are responsible for keeping your API key confidential and for all activity that occurs under your key. Notify us at hello@theoddsapi.com if you suspect your key has been compromised.

You agree not to share, resell, or sublicense your API key. Each subscription is for a single account holder. If you need multi-seat access, contact us about Enterprise terms.

4. Acceptable Use

You may use the Service to build software products that consume odds data — including odds comparison tools, analytics dashboards, betting models, research applications, and similar developer use cases.

5. Pricing, Subscriptions, and Billing

The Service is offered on tiered subscription plans. Current pricing is published on theoddsapi.com. Paid subscriptions are billed monthly in advance via Stripe. Your subscription renews automatically until you cancel. Sales tax or VAT may be added where applicable.

We may change pricing at any time. We will give you at least 30 days' notice before any price increase takes effect on your existing subscription, sent to the email address on file.

You may cancel at any time. Cancellation takes effect at the end of the current billing period. We do not pro-rate refunds for partial periods.

6. Refunds

Subscription fees are non-refundable except as required by law. If you believe you have been charged in error, contact us within 30 days of the charge at hello@theoddsapi.com and we will review the request in good faith.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be unavailable due to scheduled maintenance, third-party outages, network issues, or events outside our control. We do not offer a contractual uptime SLA on standard tiers. Enterprise customers may negotiate an SLA in writing.

Odds data is provided "as is" and reflects what we receive from external data sources. We make no guarantee that any specific odds, market, sport, or bookmaker will be available at any specific time. Coverage and freshness vary by sport and demand tier.

8. Intellectual Property

The Service, including its software, design, documentation, and the analytical signals we compute (fair odds, edge scores, consensus, settlement grading), is our intellectual property and is protected by copyright and other laws. Your subscription grants you a non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

Raw odds data reflects publicly available bookmaker prices. We do not claim ownership of those underlying prices, but we do claim ownership of our normalization, aggregation, and derived analytics.

9. Termination

You may terminate your account at any time by canceling your subscription and ceasing use of the Service. We may terminate or suspend your access immediately if you breach these Terms, fail to pay fees when due, or use the Service in a way that exposes us to legal or operational risk. On termination, your license to use the Service ends and your API key will be revoked.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, accurate, or secure. Any reliance on odds data, derived signals, or settlement grading is at your own risk.

Nothing returned by the Service constitutes betting advice, financial advice, or a recommendation to place any wager. Edge detection, fair odds, arbitrage detection, and similar signals are computational outputs based on the data we observe. They do not predict outcomes and are not guaranteed to produce profit.

11. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars ($100). We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption — even if we have been advised of the possibility.

12. Indemnification

You agree to indemnify, defend, and hold harmless TheOddsAPI and its operators from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your breach of these Terms, your violation of any law, or your violation of any third-party right.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page and, where reasonable, notify you by email. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the changes.
